5 December 2014

Since the new Commission has taken office, EPO President Benoît Battistelli has met with two EU Commissioners whose responsibilities cover the field of patents.

Today he met with the Commissioner for Competition, Margrethe Vestager in Brussels to discuss the role of patents in competition. Both parties agreed that the high quality of patents granted by the EPO plays an important role in facilitating fair competition in the marketplace. Moreover, a well-functioning Unified Patent Court (UPC) with clear rules of procedure will also help reduce the risk of distortions and anti-competitive behaviour in the market.

On 13 November Mr Battistelli met with Elżbieta Bieńkowska, Commissioner for Internal Market, Industry, Entrepreneurship and SMEs. Both sides underlined that the implementation of the regulations on the Unitary Patent was a matter of high priority, and that progress achieved by the EPO’s Select Committee in that respect was very important. Moreover, the rapid ratification of the agreement establishing the UPC by EU member states is also essential.

Both meetings proved a good occasion to underline the fruitful relationship between the two institutions, who committed themselves to even closer ties. Whenever requested by the Commission, the EPO will provide technical expertise, and will deploy all the necessary resources to ensure that unitary patent protection as entrusted to it by the EU institutions can soon become a reality.
