09.35 - 10.00 A new approach to filing at the EPO with DOCX format

The re-engineered patent process provides for a publication-ready, full-text technical specification to be available at the point of filing. This becomes possible if applications are filed in DOCX OOXML format - a format that is already being used by the vast majority of our users to draft technical specifications on their word processors. The benefit of this file format is that it is both human- and machine-readable. Filing in DOCX OOXML format will be a major step towards facilitating the filing of documents for users and avoiding the quality losses and costs of optical character recognition.

The talk will present the current situation from the perspective of both applicants and the EPO, highlight some of the concerns and propose a new, simpler route for filing based on DOCX.

As of April 2018, the EPO intends to enable users of its online services to file technical specifications and subsequently filed documents (SFDs) directly as DOCX files. In most cases, this will eliminate the need for users to convert DOCX files to PDF format before filing with the EPO.

During this interactive session we will demonstrate how to prepare and validate DOCX specifications as well as how DOCX will be incorporated into the current online filing systems.

Aimed primarily at Online Filing users, professional representatives and support staff who are familiar with the current Online Filing and now have an interest in the web-based online filing (CMS).

The next generation of online filing allows you to file patent applications with the EPO without having to install any special software. You simply access the web-based online filing system via the EPO website.

  • European patent applications - EP Form 1001
  • Subsequently filed items for all EP procedures - EP Form 1038

This workshop is aimed at IT personnel and technical support staff responsible for setting up the EPO Online Filing software in their company or interested in the technical aspects of Online Filing installation and configuration.

  • Overview of the different ways of installing Online Filing
  • Hands-on installation of associated software and hardware, including the smart card security system
  • Hands-on installation of the Online Filing software
  • Basic configuration of the Online Filing software
  • Overview of the web-based online filing (CMS) application and web-form filing

Online Filing workshop focusing on formalities and procedural requirements

This workshop is intended for users with a basic knowledge of the EPO Online Filing software who are familiar with the formal requirements for filing new applications and filing subsequent items in the EP and PCT procedures.

Practical examples from the two procedures will enable you to refresh your knowledge and give you some tips and tricks for using the Online Filing software.

This seminar covers the theory of the opposition and appeal procedures before the European Patent Office.

An overview of the applicable legal provisions and requirements for appeals and oppositions will form part of this presentation.

14.00 - 14.25 The expansion of Early Certainty

Content:
Users need a high degree of legal certainty in the patent system to enable them to monetise their ideas and inventions and get a fair return on their investment.

A major part of this certainty is the timeliness of product delivery. The EPO has mastered its search workload and now provides search reports (with an accompanying written opinion) within 6 months of filing.

The next step is to improve timeliness in examination and opposition and extend the Early Certainty initiative to those procedures.

This presentation will outline these new timeliness objectives and how they will be achieved.

Over the past ten years the EPO has invested significant amounts of time and money in databases, tools and training to help examiners access Asian documentation. The results are tangible, as almost a quarter of the patents cited in EPO search reports originate in Asia. It is now almost as easy to retrieve and cite a document in an Asian language as it is to find a European patent. Find out how this is done in the presentation on Asian documentation.

The Fourth Industrial Revolution - or "Industry 4.0" - is a revolution in connectivity and distributed intelligence. It is characterised by driving technologies such as the Cloud, Big Data and the Internet of Things, and by the presence of computer technologies in every aspect of our lives. The consequences for intellectual property are potentially tremendous, and they challenge some of the fundamental concepts of the system, such as the definition of "industry" and "inventor". There will be greater overlap and interplay between IP right types, and as software pervades all technologies there will be greater debate about its patentability. Patent offices will have to react to these changes, adapting their approaches. Industry 4.0 will also have an impact on patent information, bringing new challenges for patent searchers.
